William and Lucy Northen to Bartholomew McCarty
June 10,
1814
This indenture made the 10th day of June in
the year of our Lord one thousand eight hundred and fourteen and in the 38th
year of the Commonwealth of Virginia between William Northen and Lucy his
wife of the county of Richmond and parish of North Farnham of the one part
and Bartholomew McCarty of the county and parish aforesaid of the other
part. Witnesseth that the said William Northen and Lucy his wife for and in
consideration of the sum of nine hundred dollars lawful money of Virginia to
him the said William Northen in hand paid by the said Bartholomew McCarty
the receipt whereof he doth hereby acknowledge have granted, bargained, sold
and conveyed and by these presents do grant, bargain, sell and convey unto
the said Bartholomew McCarty, his heirs and assigns a certain tract, piece
or parcel of land lying and being in the county and parish aforesaid which
was allotted to him the said William Northen in the division of the land of
his father Peter Northen deceased and is a part of the land purchased by the
said Peter Northen from Joseph Fauntleroy canned the low grounds described
in the platt and survey of the said division No. 4 made by Thomas Stowers
containing seventy five acres. Beginninf at a large red oak near a green
corner to John B. Garland orphan of Peter R. Garland deceased called
Peacocks and the land formerly Leroy Peacheys late William’s and in the line
of Mrs. Wilalmina Haynick’s land, thence with Mr. Haynies line S 25 degrees
30 minutes E 58 poles to a white oak. Thence S56 degrees 30 minutes W 16
poles to a stake corner with Miss Fanny Downman late Colestons land. Thence
S 42 degrees 15 minutes E 102 poles to a stake near a cedar. Thence N 25
degrees 30 minutes S to a stake. Thence N 68 degrees 30 minutes W along the
line of the said land called Peacocks to the beginning red oak. To have and
to hold the said tract, piece or parcel of land containing seventy five
acres be the same more of less with the appurtenances thereto belonging to
him the said Bartholomew McCarty his heirs and assigns to the only proper
use and behoof of the said Bartholomew McCarty his heirs and assigns forever
and the said William Northen and Lucy his wife for themselves and their
heirs, executors and administrators do hereby covenant and agree to and with
the said Bartholomew McCarty his heirs and assigns against them the said
William Northen and Lucy his wife and against all persons whatsoever shall
will and by these presents forever warranty and defend. In witness whereof
the said William Northen and Lucy his wife have hereunto set their hands and
affixed their seals the day and year first above written.

Received the day of the date of the within indenture of
the within named Bartholomew McCarty the sum of nine hundred dollars the
consideration in full for the land and premises by the within deed conveyed.

The Commonwealth of Virginia To John Darby, Henry M.
Dobyns, Martin Sisson, George Sanders and Richard M. Glascock, Gentlemen
Justices of Richmond County, greeting, whereas William Northen and Lucy his
wife by their certain indenture of bargain and sale bearing date the 10th
day of June 1814, have sold and conveyed unto Bartholomew McCarty a certain
tract, piece or parcel of land lying and being in the county of Richmond and
parish of North Farnham containing seventy five acres more or less. And
whereas the said Lucy can not conveniently travel to our county Court of
Richmond to make acknowledgement of the said conveyance, therefore we do
give unto you any two or more of you power to receive the acknowledgement
which the said Lucy shall be willing to make before you of the conveyance
aforesaid conained in the said Indenture which is hereunto annexed. And we
do therefore command you that you do personally go to the said Lucy and
receive her acknowledgement of the same and examine her privately and apart
from the said William Northen her husband, whether she doth the same freely
and voluntarily without his persuasion or threats and whether she be willing
that the same should be recorded in our said county Court of Richmond
aforesaid. And when you have received her acknowledgement and examined her
as aforesaid that you distinctly and openly certify us thereof in our said
County Court under your seals, sending then there the said indenture and
this writ witness Bartholomew McCarty clerk of our said County Court this 13th
day of June 1814 and in the 38th year of the Commonwealth.

Richmond County to wit
Pursuant to the within commission to is directed we did
this day examine the within named Lucy Northen privily and apart from
William Northen her husband and do certify that she did before is
acknowledge as her act and deed the indenture hereto annexed which was by
us then shown and explained to her, the said Lucy Northen, declaring to us
that she made the said acknowledgement freely and voluntarily without this
persuasions or threats of her said husband and was willing the said
indenture should be recorded in the county court within mentioned certified
under our seals this 28th day of June 1814.

At a court of quarterly sessions held for Richmond
County the 8th day of November 1814:
This deed of indenture and sale from William Northen
and Lucy his wife to Bartholomew McCarty with the receipt endorsed was
acknowledged in court by the said Northen and admitted to record. A
commission for the privy examination of said Lucy returned executed and also
admitted to record.
