Berrick Northen Estate Settlement by Minty Northen
January
29, 1795
This indenture made the twenty ninth day of January in
the year of our Lord one thousand seven hundred and ninety five and in the
nineteenth year of the Commonwealth of Virginia between Minty Northen
(attorney in fact appointed by Elizabeth Northen of the County of Frederick
and relict of Edmund Northen deceased as her lawful attorney as appears by
the Records of the District Court of the Counties of Frederick, Berkeley,
Hamshare, Hardy and Shenandoah bearing date the first day of September one
thousand seven hundred and ninety four being had will more full and at large
appear authorizing the said Minty Northen to settle all her business
respecting the estate left her by her father George Berrick in the County of
Richmond) of the one part and Griffin Garland Berrick of the County of
Richmond of the other part. Witnesseth that the said Minty Northen for and
in consideration of the sum of thirty seven pounds current money of Virginia
to me in hand paid by the said Griffin Garland Berrick the receipt whereof I
do hereby acknowledge hath give, granted, bargained and sold, aliened and
confirmed and by these presents doth grant, bargain and sell, alien and
confirm unto the said Griffin Garland Berrick, his heirs and assigns forever
all that messuage, tenement or tract or parcel of land which fell to the
said Elizabeth Northen by her lot as stated in the surveyors plot (number
one) which did belong to her father George Berrick deceased of the aforesaid
County of Richmond as appears by his last Will and Testament bearing date
the first day of August one thousand seven hundred and seventy, now on
record, being had will more fully and at large appear, containing fifty
acres and bounded as follows (that is to say) Beginning at a dead red oak or
Spanish oak corner to Benjamin Bramham and in the line of Vincent Bramham
running thence North fifty two degree west sixty two poles to a stake in the
center of the swamp the main branch of Bryers Creek and corner to John
Purssell thence running up the said branch its several meanders binding on
John Purssell’s land to a stake in the center of a branch of the same being
the Spring Branch, thence south nine degrees east seventy eight poles to a
stake in the line with Benjamin Bramham thence to the beginning. And all
lands, trees, woods, underwoods, pastures, marshes and meadows, profits,
advantages, buildings, yards, gardens, hereditaments, ways, water, water
courses and appurtenances whatsoever to the said messuage, tenement, tract
or parcel of land and premises above mentioned belonging or in any ways
appertaining and also the reversion and reversions, remainder and
remainders, rents and services of the said premises and of every part and
parcel thereof and also the estate right, title, interest, claim and demand
whatsoever of them the said Minty Northen and Elizabeth Northen in and to
the said messuage, tenement and premises and every part thereof. To have
and to hold the said messuage or tenement and all and singular the said
premises above mentioned or intended to be mentioned and every part or
parcel thereof, with the appurtenances unto the said Griffin Garland Berrick,
his heirs and assigns to their proper use and behoof of the said Griffin
Garland Berrick, his heirs and assigns forever and the said Minty Northen
and Elizabeth Northen for themselves and their heirs the said messuage or
tenement or premises and every part thereof against them and their heirs and
against all and every other person and persons whatsoever to the said
Griffin Garland Berrick, his heirs and assigns shall and will warrant and
defend by the presents they the said Minty Northen and Elizabeth Northen
doth further covenant, grant and agree to and with the said Griffin Garland
Berrick, his heirs and assigns that their will make, do and execute any
other lawful acts or acts, conveyances and assurances in the aw for the more
sure making and confirming of the said bargained premises to the said
Griffin Garland Berrick, his heirs and assigns when thereunto required as by
him and them or his or their council learned in the law be devised, advised
or required. In witness whereof I have hereunto set our hands and seal the
day and year above written.

This Deed of Bargain and Sale from Minty Northen,
attorney in fact for Elizabeth Northen of the one part and Griffin Garland
Berrick of the other part with the receipt thereon endorsed was proved in
open curt by the oath of Griffin Garland, Benjamin N. Garland and William
Northen three of the witnesses thereto and admitted to record.
